eWISE - January 2015

Welcome to the first WISE newsletter for 2015!

This year looks like another exciting year for WISE with our investigation services continually expanding. We have continued to add to our experienced investigation teams over the Christmas break and will soon be announcing the opening of offices in Canberra and Hobart!

In anticipation of Melbourne hosting the International Investigative Interviewing Research Group's annual conference in June this year, you can now download a free extract of our award-winning book on the theory of PEACE interviewing from our home page for a limited time. Download Here

We will be working closely this year with top international academics to bring expert knowledge and training to workplace investigators around the country.

Further details of special events will become available in the coming months.

Here are some of our top blogs from December/January, and don't forget to scroll down to view the What's On section!

Drinking on the Job: Expensive Lessons for Employers

By Harriet Stacey

In the recent case of Willis, Judge Taylor of the NSW District Court found that an employee’s drunken attendance at a work conference session did not amount to serious misconduct. His Honour noted that the employer’s permissive attitude towards alcohol and socialising was such that the decision to immediately terminate was inappropriate in the circumstances. We examine the way that employer attitude, contract provisions and documented policies can all impact upon a finding of misconduct in such cases. Read more here

Workplace Bullying and the Meaning of "At Work"

By Harriet Stacey

A recent FWC case pays close attention to whether workplace bullying has occurred ‘at work’. Of particular interest, the full bench examines the application of workplace bullying provisions to the complex environment of social media. We examine the case in the light of growing ‘places’ of workplace bullying, plus look to the FWC’s treatment of the ‘at work’ dilemma. Read more here.

Want to Audio Record Interviews But Not Sure How?

By Harriet Stacey

Many workplace investigators understand the merit of making an audio recording during interviews. Accuracy is generally built into the transcript, making this a document of high probative value in many cases. Yet issues can arise around the permission to record, which brings questions of lawfulness and propriety to the process. These factors, as well as quality introductions and valid transcript usage are worth bearing in mind long before you press the record button. Read more here.
