What's New

This month there has been a number of news reports regarding privacy laws and security. In 2010 the Fair Work Commission (FWC) found that employees could not assume social media activity was private, and warned it was foolish to think an employee could say what they liked on Facebook with 'total immunity'. 

In a more recent case the FWC assessed that an 'employee should have an expectation of a reasonable private life, even when using social media.' Meaning, that the persons online activities do not automatically lead to termination being justified. 

Business are entitled to protect their brand and reputation and expect that employees will not make public statements to damage it. It is therefore, important to have a social media policy in place to clarify what is acceptable or unacceptable online behaviour.

The Australian Human Rights Commission has begun the fourth national survey into workplace sexual harassment. The Commission has undertaken regular surveys on workplace harassment since 2002, the latest having taken place in 2012. More information can be found on their website

The Fair Work Commission's online version of the Anti-Bullying benchbook has been updated. This benchbook contains plain summaries of the key principles of workplace bullying case law, and how these have been applied in Commission decisions. It has been specifically designed to assist parties lodging or responding to anti-bullying applications under the Fair Work Act 2009
